About DMCA and Copyright Policy

Adrenaline Realm ("the Company," "we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. This DMCA and Copyright Policy explains how copyright owners can report infringement and how users can submit counter-notifications. It applies to the Adrenaline Realm platform, mobile application, and website located at www.adrenalinerealm.com (the “Service”).

In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), the text of which may be found on the U.S. Copyright Office website at https://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement reported to our Designated Copyright Agent. This includes situations where build photos, videos, or other content are posted or shared on the Service without the copyright owner’s permission.

1. Notice of Copyright Infringement

If you are a copyright owner, or are authorized to act on behalf of one, please report alleged copyright infringements taking place on or through the Service by completing a DMCA Notice of Alleged Infringement (“Notice”) and delivering it to our Designated Copyright Agent. Upon receipt of the Notice as described below, Adrenaline Realm will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Service.

To be effective, the Notice must include the following information:

  1. Identify the copyrighted work that you claim has been infringed, or—if multiple copyrighted works are covered by this Notice—you may provide a representative list of the copyrighted works that you claim have been infringed.

  2. Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material, including at a minimum, if applicable, the URL of the link shown on the Service where such material may be found.

  3. Provide your mailing address, telephone number, and, if available, email address.

  4. Include both of the following statements in the body of the Notice:

  5. "I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."

    • "I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."

  6. Provide your full legal name and your electronic or physical signature.

2. Counter-Notification Procedures

If you receive a notification that material you posted on the Service has been removed or disabled due to a DMCA Notice, and you believe the material was removed or disabled due to a mistake or misidentification, you may dispute the removal by submitting a counter-notification (“Counter-Notice”) to our Designated Copyright Agent.

To be effective, your Counter-Notice must include the following information:

  1. Identification of the material that has been removed or disabled and the location where it appeared before it was removed or disabled (include any relevant URL/link, post details, and username/account, if available).

  2. Your name, address, and telephone number (and email address, if available).

  3. The following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."

  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are outside the United States, that you consent to the jurisdiction of the federal courts located in Boise, Idaho), and that you will accept service of process from the person who provided the original Notice (or that person’s agent).

  5. Your physical or electronic signature.

Upon receipt of a valid Counter-Notice, Adrenaline Realm will promptly provide the person who submitted the original DMCA Notice with a copy of the Counter-Notice and inform that person that Adrenaline Realm may replace the removed material or cease disabling access to it in 10 to 14 business days, unless our Designated Copyright Agent receives notice that the original complaining party has filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on the Service.

3. Repeat Infringer Policy

Adrenaline Realm takes copyright protection seriously. In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the access and/or accounts of users who are deemed to be repeat infringers, including termination of accounts for multiple violations. We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

4. Liability; Third-Party Content

The Service may allow users and third parties to post, upload, or share content. We are not responsible for third-party content and do not control or endorse content posted by users or other third parties. However, we are committed to responding to valid DMCA notices and, upon receipt of a valid Notice (and as applicable, a valid Counter-Notice), we will act expeditiously to remove, disable access to, or restore content as required by the DMCA and applicable law.

5. Modifications

Adrenaline Realm reserves the right to modify the contents of this page and its policy for handling DMCA notices at any time for any reason. You are encouraged to check this policy periodically for any changes.
